Terms and Conditions
General Terms and Conditions for the purchase of gift vouchers via mos-steakhouse.de
This is a translation provided for convenience. In case of doubt, the German version applies.
§ 1 Scope
(1) These General Terms and Conditions apply to all contracts for the purchase of gift vouchers concluded with MO’s Gastronomie GmbH via the website mos-steakhouse.de.
(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (Section 13 of the German Civil Code, BGB).
(3) Any conflicting terms of the buyer apply only if we have expressly agreed to them.
§ 2 Contracting party
Your contracting party is MO’s Gastronomie GmbH, Max-Eyth-Straße 35, 71088 Holzgerlingen, Germany, represented by Aneta Kanasz, registered with the commercial register of the Stuttgart Local Court under HRB 788568. Phone: +49 7031 4289500, email: info@mos-steakhouse.de.
§ 3 Conclusion of the contract
(1) The presentation of the vouchers on the website is not a legally binding offer but an invitation to place an order.
(2) In the order window you choose the amount and number of vouchers and enter the recipient’s email address, your name and, if you wish, a personal message. “Continue to payment” takes you to the payment page of our payment service provider Stripe, where you can see your order and the total price once more. You can correct input errors by going back to the website and changing your details in the order window. By clicking the payment button you submit a binding offer to buy the vouchers.
(3) The contract is concluded when we accept your offer. We accept it by sending the voucher by email after successful payment. You will also receive an order confirmation by email containing your order details, these terms and the cancellation policy.
(4) The contract language is German; orders can also be placed in English. We store the order data. You can view and print these terms on this page at any time.
§ 4 Prices and payment
(1) Vouchers are available for 25, 50, 75 or 100 euros. The price equals the voucher value. All prices are final prices; there are no delivery costs.
(2) Payment is processed by the payment service provider Stripe Payments Europe, Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland. The available payment methods are shown on the payment page. The purchase price is due when you place the order.
§ 5 Delivery
(1) After receipt of payment the voucher is sent by email to the recipient address you entered, usually within a few minutes. You receive a copy at the email address you gave when paying.
(2) You are responsible for entering the correct recipient address. If an address is wrong, we will send the voucher to a corrected address on request, as long as it has not been redeemed.
§ 6 Redemption and validity
(1) The voucher can be redeemed for food and drinks at MO’s Steakhouse, Max-Eyth-Straße 35, 71088 Holzgerlingen. Please show it when paying, printed or on your smartphone.
(2) The voucher is valid until 31 December of the third year after the year of purchase. The exact date is shown on the voucher.
(3) The voucher can be redeemed in part. Any remaining balance stays valid until the voucher expires. It cannot be exchanged for cash.
(4) The voucher is transferable. We may perform to any person presenting the voucher code unless we know that this person is not entitled. If the email is lost, we will resend the voucher on request to the address given in the order, as long as it has not been redeemed.
§ 7 Right of withdrawal
Consumers have a statutory right of withdrawal. Details can be found in the cancellation policy. You can also withdraw from the contract online using the “Withdraw from contract” button linked at the bottom of every page. Upon withdrawal, the related voucher codes become invalid.
§ 8 Liability
(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act.
(2) In the case of slight negligence we are only liable for breach of an obligation whose fulfilment is essential for the proper performance of the contract and on whose observance you may regularly rely. In this case liability is limited to the typical, foreseeable damage.
§ 9 Dispute resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
§ 10 Final provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the country in which they have their habitual residence.
(2) If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from this contract is our registered office in Holzgerlingen.
(3) Should any provision of these terms be invalid, the remaining provisions shall remain effective.
